It is actually up to the theater to decide if they want to enforce ratings. Ratings are not enforceable by law, but most theaters comply anyway. You can go to Best Buy and purchase an "R" rated movie (although you have to show ID at Best Buy for an "M" video game, which makes no sense) regardless of your age.

I saw the link on Whedonesque too and I sincerely hope the site is wrong, or at the very least if the movie does get pushed back, it's not a very long wait. I'm sick of waiting to see this.

We're likely not going to get anything new on this film until MGM sorts out its financial mess. And that could take a while. I think distribution deals have an expiration date, so there could be some hope that it gets released into the wild for someone else to pick up, but that could be years.
This isn't the only film suffering from MGM's financial issues - the new James Bond film with Daniel Craig was canned for the same reason. There's a lot of uncertainty with the properties under MGM's control right now. We're just playing a very uncomfortable waiting game -- like the WGA strike.
/sigh At least we know it's completely finished, so as soon as there's money to distribute it, it will get a close release date (give it maybe 3-6 months for advertising).
